The general rule is three years from the date of injury (M.G.L. c. 260, § 2A). But several exceptions catch people out.
Shorter deadlines
- Claims against a city, town or the MBTA — a written presentment within two years (M.G.L. c. 258, § 4).
- Sidewalk and road defects — written notice within 30 days (M.G.L. c. 84, § 18).
Longer deadlines
For minors, the three-year clock generally does not start until they turn 18.
